Title IX Annual Notifications

All schools in the District are required to notify parents and employees of the District’s Sexual Harassment Policies.  The following are the requirements to be followed at each school, followed by the resources needed to comply with these requirements:

A copy of the district's sexual harassment policy and regulations shall be:

1)   included in the notifications that are sent to parents/guardians at the beginning of each school year (California Education Code Section 48980; Title 5, California Code of Regulations Section 4917)

The District’s Facts for Parents booklet is updated and published annually and distributed to all students/families at all school site.  This publication includes summaries of the District Sexual Harassment Policies and Sexual Harassment Complaint Procedures.  School sites must distribute theses booklets annually.  The Facts for Parents booklet is also available on the District’s web site.

2)   displayed in a prominent location in the main administrative building or other area where notices of district rules, regulations, procedures, and standards of conduct are posted (California Education Code 231.5)

 Post the following in the school’s main office, all meeting locations (for students, staff, and parents):

Nondiscrimination Statement and Notice of Sexual Harassment Complaint Procedures  NOTE:  The requirement to post (at all schools and District offices) the full sexual harassment policies is a new requirement as of the 2020-2021 school year.

AR 5145.7, BP 5145.7, and AR 5145.71 –These full policies can be found on the District's Policies and Procedures-Title IX page.

3)   summarized on a poster which shall be prominently and conspicuously displayed in each bathroom and locker room at each school.  The poster may be displayed in public areas that are accessible to and frequented by students, including, but not limited to, classrooms, hallways, gymnasiums, auditoriums, and cafeterias. The poster shall display the rules and procedures for reporting a charge of sexual harassment; the name, phone number, and email address of an appropriate school employee to contact to report a charge of sexual harassment; the rights of the reporting student, the complainant, and the respondent; and the responsibilities of the school.  (California Education Code Section 231.6)  

This requirement stems from Assembly Bill 543 which requires the aforementioned poster to be posted in all HIGH SCHOOL libraries and restrooms.  This 8.5 x 11 printable MUST be posted in all high school libraries and restrooms, however we recommend that all schools post them in classrooms as well. 

Although these posters are not yet required in elementary and middle schools, we recommend they be posted in all libraries, restrooms and classrooms.

4)   posted in a prominent location on the district's web site in a manner that is easily accessible to parents/guardians and students. This shall include the name or title, office address, email address, and telephone number of the employee(s) designated as the district's Title IX Coordinator.  (California Education Code Section 234.6; Title 34, Code of Federal Regulations Section 106.8)

5)   provided as part of any orientation program conducted for new and continuing students at the beginning of each quarter, semester, or summer session (California Education Code Section 231.5)

Schools are required to include sexual harassment education annually for all returning and new students at the beginning of each school year, and at the semester and during summer sessions.  The following slide shows are customizable and can be used as springboard for your semester behavior/conduct assemblies and/or classroom presentations.
